1. Identification of the owner

2. Acceptance of the terms

By creating an account, accessing or using Cimientos, you accept these Terms and Conditions. If you do not agree, do not use the Service.

3. Minimum age

The Service is intended for people over 18 years old. If you are under 18, you must not create an account or take out a Subscription.

4. Description of the Service

Cimientos offers features aimed at nutrition tracking and, potentially, training (for example, logging meals/recipes, ingredients and nutritional summaries).

The Service may evolve and change (adding, modifying or removing features) to improve the experience, security or maintenance.

5. User account

  • You must provide truthful information and keep it up to date.
  • You are responsible for the confidentiality of your credentials and for all activity carried out from your account.
  • We reserve the right to suspend or cancel accounts in the event of fraudulent use, abuse, legal non-compliance or breach of these terms.

6. Permitted use and prohibited conduct

You agree not to:

  • Use the Service for unlawful purposes or to infringe the rights of third parties.
  • Interfere with the security or operation of the Service (e.g., introducing malware, engaging in abusive scraping, or performing unauthorized load testing).
  • Access or attempt to access areas, data or systems without authorization.
  • Use the Service in a way that degrades its availability for other users.

7. User content

You may enter data such as recipes, meals, ingredients, names and other content (hereinafter, “User Content”).

  • You retain ownership of your User Content.
  • You grant us a limited, worldwide, non-exclusive license to host, process and display such content solely for the purpose of operating the Service.
  • You warrant that you have the necessary rights to the content you upload (including images), and that it does not infringe the rights of third parties.

8. Nutritional and health information (disclaimer)

Cimientos does not provide medical advice. The information displayed (for example, calories, protein or other values) is indicative and may contain errors. Consult healthcare professionals before making significant changes to your diet or physical activity.

In case of illness, allergies, pregnancy, injury or other conditions, use the Service with caution and under professional supervision.

9. Payment plans, subscriptions and billing

Some features may require payment or a subscription (hereinafter, “Subscription”). Price, periodicity and feature details will be shown before purchase.

9.1 Price and periodicity

Unless otherwise stated at the time of purchase, the Subscription has a price of 5.00 € per month (VAT included) and renews monthly.

9.2 Payment processing with Stripe

Payments are processed through Stripe (a third party). By purchasing, you accept that Stripe processes your payment data in accordance with its terms and policies. More information: https://stripe.com/legal

We do not store your card data. Stripe may store and process such data on our behalf.

9.3 Trial period (14 days)

The Subscription may include a free trial period of 14 days.

The trial is offered so you can evaluate the Service. At the end of the trial period, you will not be charged automatically unless you explicitly complete the paid subscription process (for example, by entering a payment method and confirming the purchase).

9.4 Renewal, cancellation and changes

  • Unless otherwise indicated, the Subscription renews automatically at the end of each period.
  • You can cancel the renewal at any time; the cancellation will take effect at the end of the already paid period, unless otherwise indicated.
  • We may change prices or plan conditions with reasonable notice when legally required. Changes will apply at the next renewal.
  • If a charge fails or is reversed (for example, due to an expired payment method), we may suspend or limit access to paid features until the situation is regularized.

9.5 Refunds

Refund policy: refunds are not offered, unless applicable law requires otherwise.

Nothing in these Terms limits the non-waivable rights you may have as a consumer under applicable law.

9.6 Withdrawal right (consumers)

If you contract as a consumer in Spain or the EU, you may have a 14-day withdrawal right in certain distance contracts. However, for digital services, if you request that the service begin immediately, withdrawal may be excluded or may lead to payment of the proportional part, as applicable and in accordance with applicable law.

10. Availability, maintenance and changes

We try to keep the Service available, but we do not guarantee uninterrupted availability. There may be interruptions due to maintenance, incidents or causes beyond our control.

11. Intellectual property

The Service, its design, brand, code and materials (except User Content) are the property of the owner or its licensors and are protected by applicable law. No rights are granted except those expressly indicated.

12. Limitation of liability

To the extent permitted by law, the Service is provided “as is”. We will not be liable for indirect damages, loss of profits, loss of data or damages arising from the use or inability to use the Service.

13. Data protection

Personal data processing will be carried out in accordance with applicable law (including the GDPR) and the privacy information provided within the Service.

In particular, for payments, Stripe's policies also apply.

14. Cookies

The Service may use cookies or similar technologies strictly necessary for user login and session maintenance. We do not use advertising or tracking cookies for marketing purposes.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or for security, legal or technical reasons.

16. Applicable law and jurisdiction

These Terms shall be governed by the laws of Spain. Any dispute shall be submitted to the courts and tribunals of Albacete, unless consumer law establishes a different jurisdiction.
